- Is the debtor being honest ?
- Is there any vaible defence, counterclaim or technicality which could damage a court claim or have unforeseen consequences for you ?
- Is the position on the debt clearly documented and are you sure you can pursue the correct company, individuals or legal entity
- How much is the debt ? Is it sensible and proportionate to incur legal fees, can they be recovered i.e is the claim a small claims matter ?
- Does the debtor have something to lose if a judgment is obtained, with the ultimate threat of winding up or bankruptcy ?
- The general attitude of the debtor. Is the debtor likely to simply ignore phone calls and letters from debt collection agencies
